Congratulations on purchasing your new Dr. Fascia Product [Doctor Fascia Breakthrough Tool] (the “Product”). The information in this document affects your safety and your legal rights and responsibilities with respect to the Product and [Dr Fascia LLC] (the “Company”).
Please read this document carefully. Failure to read and follow instructions and warnings in this document may result in serious injury to yourself, others, or damage to the Product.
By use the Product, you signify that you have read this Disclaimer and Warning carefully and agree to abide by the terms and conditions herein.
Your Responsibilities
You agree that: (a) use of the Product is not a substitute for the consultation, diagnosis, and/or medical treatment provided by your doctor; (b) you will consult your doctor before using the Product; (c) the Product is not a toy, and that adult supervision is necessary when the Product is used by children or people with disabilities; (d) you are solely responsible for your own conduct while using the Product, and for any consequences thereof; (e) you will use the Product only for purposes that are proper and in accordance with all applicable laws, rules, and regulations; (f) you will properly maintain the Product as set forth below.
You also agree that you will not use the Product if: (a) you have a history of or may have blood clots, deep vein thrombosis; (b) you have recently, are currently, or will be taking blood thinning medications; (c) you have varicose veins or history of vascular disease; (d) you are pregnant; (e) have heart disease; (f) you are diagnosed with hypertension; (g) have a history of skin disease; (h) you are under the age of 18; (i) or you have any injuries, pre-existing health concerns or diagnosed medical conditions without first consulting your trusted health care provider.
The product is intended for self-use. You acknowledge that, if you are a practitioner of any type and choose to use the Product on another individual, you are subject to your state laws and other standards of practice and will practice within your professional scope and authority.
Some users have reported side effects such as bruising, petechia, skin irritation, muscle soreness, nerve inflammation, numbness and tingling. If you are concerned about any atypical effects that you are experiencing, please see your Doctor.
Care and Maintenance
In order to keep the Product maintained properly, please sanitize after every use; avoid dropping it on hard surfaces like concrete; as it may alter the smooth edge causing a rough spot unsuitable for use over the skin; transport the Product in carrying sleeve.
Limited Warranty
Company warrants the Product against defects in materials and/or workmanship under normal use for a period of ONE (1) YEAR from the date of purchase by the original purchase (“Warranty Period”). If a defect arises and a valid claim is received within the Warranty Period, at its option, Company will either (1) repair the defect at no charge, using new or refurbished replacement parts, or (2) replace the Product with a new product that is at least functionally equivalent to the original Product, or (3) provide a credit in the amount of the purchase price of the original product. When the Product is exchanged, any replacement item becomes your property and the replaced item becomes Company’s property. When a store credit is given, the original Product must be returned to Company and becomes Company’s property. Company cannot warrant against failures due to abuse, misuse, accident, natural disasters, unauthorized alteration, repairs or modifications of the Product.
The above warranty provides you with specific legal rights. You may have additional rights that may vary from state to state. because of the individual state regulation, some of the above limitations and exclusions may not apply.
Other than as set forth above, the Product is provided “as is”, without further warranty of any kind, either express or implied. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
If you choose to use the Product, you do so voluntarily and at your sole risk. In no event shall Company, including our affiliates, subsidiaries, parents, successors and assigns, and each of our respective officers, directors, employees, agents, or shareholders, be liable to you or any other entity for any incidental, special, exemplary, punitive, consequential, or indirect damages (including personal injury or emotional stress to you or other affected persons or property, or the cost of procurement of substitute services) arising out of or in connection with your use or inability to use the Product.
Indemnification
You agree to release, defend, indemnify, and hold Company and its affiliates and subsidiaries, and their officers, directors, employees and agents (including, without limitation, Dr. Bryan Geier), harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Product or your violation of these terms.
